Terms of Service1. DEFINITIONS(a) "Atomicsoft", "We": Atomicsoft Ltd., Zabolonogo str. 114-63, 03187 Kiev, Ukraine(b) "Client", "You", "Licensee": A person or company, for which these terms of service apply. (c) "Software": Atomicsoft software program(s), related software components, supplied by Atomicsoft herewith, and corresponding documentation, associated media, and online or electronic documentation. (d) "Software License": the license key, issued to a designated user, which enables the user to run the Software on a designated Domain Name. 2. SOFTWARE LICENSE GRANTS AND RESTRICTIONS(a) The Software License grants the Licensee the right to install one instance of the Software for use with a single domain name and it's subdomains.(b) The Software License can not be transferred to another party without express written consent from Atomicsoft. (c) You may not reverse engineer, decompile, defeat license encryption mechanisms of the Software or Software License. (d) The Licensee may modify or change the Software code to suit the Licensee's needs, at the Licensee's own risk. The Licensee is not permitted to resell or distribute the modified code, nor the original source code. 4. INTELLECTUAL PROPERTY RIGHTSThe Software is protected by Ukrainian and international copyright laws and treaties, as well as other intellectual property laws and treaties. You must not remove or alter any copyright notices on any copies of the Software. This Software copy is licensed, not sold.5. TERMINATION OF LICENSEAtomicsoft reserves the right to terminate, at any time, a license if the Licensee breaches any clauses described in the current license agreement. In such event, Licensee agrees to return to Licensor or to destroy all copies of the Software upon termination of the License.6. SUPPORT SERVICES.(a) All support requests are processed very carefully, however we give no warranty for the accuracy and usefulness of provided support services.(b) Unlimited installation support is applicable for 1-st time installation. Support is not transferable and will not be granted for re-installations. We reserve the right to refuse the processing of support requests at any time. Support is provided exclusively for the e-mail address used to order concerned Software. (c) Limited technical support / enhanced support: Paid support is not transferable. Covers all installation related and technical inquiries. Depending on the selected contract, the e-mail addresses from which support requests are accepted can be limited. 7. INSTALLATION SERVICEIncludes basic installation and configuration procedure. A full money-back-guarantee is provided in the case that installation is not successful (only applicable if the installation service was ordered before the concerned Software was made available to the Client).8. WARRANTIESThe Software and its accompanying files are sold "as is" and no warranties, whether explicit or implied, are valid. Atomicsoft makes no warranty of the fitness of Software for a particular purpose.9. LIMITATION OF LIABILITYAny liability of the seller will be limited to only product replacement or refund of purchase price. By agreeing to this license agreement you, the Licensee, agree that Atomicsoft can not be held accountable for any use of Software, nor any damage caused by its use.10. GOVERNING LAWThis license agreement is governed by the laws of the Ukraine.
